At one point during the seven-hour stopover, an unrestrained Rohan Arnold says he took happy snaps of five Australian officials near the Eiffel Tower, using one of their mobile phones.

The AFP confirmed it is currently investigating the claims, outlined in court documents in support of a bail bid by Mr Arnold.

Mr Arnold – along with Tristan Waters, 34, and David Campbell, 48 – was dramatically arrested by Serbian authorities over the importation of 1280 kilograms of cocaine, worth an estimated $500 million, into Australia.

The trio were allegedly handing over a bag containing a gun and $1 million in cash at a Belgrade hotel in January.

Police seized 2576 individual blocks of cocaine, which had been secreted inside prefabricated hollow steel on a Chinese container boat in Sydney last April.

Mr Waters is fighting his extradition and remains behind bars in Serbia, while Mr Campbell returned to Australia on Tuesday and is locked up in NSW.

Mr Arnold – who did not oppose his extradition and has been behind bars since he arrived back in Australia in March – is set to seek bail in the NSW Supreme Court on Thursday.

The prominent Canberra-region businessman has been charged with five counts of importing drugs. The maximum penalty for each charge is life imprisonment.

He has pleaded not guilty.

Documents filed by the accused's lawyer, Ben Aulich, include details of the unorthodox extradition from Serbia to Australia, where an unrestrained Mr Arnold accompanied his minders on a tour of the city of light during a seven-hour stopover between connecting flights.

Mr Arnold says the group were dropped off near the Eiffel Tower after a 40-minute taxi ride from Paris's Charles de Gaulle Airport.

A taxpayer-funded credit card was then used to pay for a $300 breakfast at a cafe near the iconic landmark.

Mr Arnold – who had spent a week in Paris only 18 months earlier – acted as tour guide as the party then strolled to the Eiffel Tower, before he led the expedition on foot to the Champs-Elysees and the Arc de Triomphe.

The prisoner also guided the group back to where they had been dropped off – a journey of 30 minutes, which included a search in an underground train station for a bathroom – where they caught a taxi back to the airport.

At the airport, French officials were upset to hear Mr Arnold had been taken out of the airport and into Paris.

Documents claim Mr Arnold could have easily escaped police custody in Paris as he had been unrestrained, was familiar with the area around Eiffel Tower, and the precinct had been swarming with tourists at the time.

Mr Arnold also is said to have declined an offer to challenge his detention in Serbia, instead telling his lawyers to get him home as soon as possible.

The AFP said Mr Arnold had been escorted at "all times by four sworn Australian Federal Police officers" during the March 21 extradition.

"It is not appropriate for the AFP to comment on security procedures during extradition processes," an AFP spokesman said.

"The AFP is currently assessing the veracity of these claims."

The defence submissions argue Mr Arnold should be granted bail as he has no criminal history, has strong links, active business interests, and faces a long wait for trial as one of his co-accused, Mr Waters, is still in Serbia.

Defence counsel, Jack Pappas, in his submissions, argued the court's only concern on freeing Mr Arnold on bail would be that he posed a flight risk.

"[This] concern must be significantly eroded by the circumstances in which the applicant was brought back to Australia from Serbia under what could only be described as lax security, consistent with no real fear of him absconding," Mr Pappas wrote.

Mr Arnold has offered to abide by 13 strict bail conditions if released, including wearing an electronic tracking bracelet, reporting to police daily, surrendering his passport, not contacting his co-accused, and a surety.
