John McGrath Auto Group Black Opal Stakes Car Giveaway - Terms and Conditions

 

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to ACT & NSW residents aged 18 years or older.
  3. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 
  4. Promotion commences on Monday, 13 February 2023 and closes at 11:59pm, Sunday, 26 February 2023 (“Promotional Period”).
  5. To enter, eligible entrants must, during the Promotional Period:
    1. Purchase a copy of The Canberra Times or access the digital version with a premium digital subscription to The Canberra Times.
    2. Locate the daily secret code word 
    3. Visit the website and locate the landing page with the entry form embedded - www.canberratimes.com.au/cargiveaway
      OR click on a promotional banner advertisement linking to the landing page,
      OR scan the QR code in print advertising, 
    4. Complete the entry form with a valid secret code and all requested details including, but not limited to full name, mobile phone number and email address, and submit the completed form. A new form will need to be completed for each edition with the unique secret code for that day.
  6. Multiple entries permitted subject to the following: 
    • A secret code word will be published in each edition of The Canberra Times during the promotional period. Entrants must purchase a copy of the publication and complete the online entry form with a different valid code word for each entry in order to be in the running to win. An entrant may enter only once per valid code word but can enter up to 14 times using each of the daily code words - a different code word submitted on each entry form. Only one (1) entry permitted per person per secret code word with the secret code word changing daily in the newspaper ad.
  7. Bonus entries permitted subject to the following:
    • Members of the Canberra Racing Club will receive one bonus entry into the competition for each valid entry submitted. Entrants must be a current Member at the time of entry to qualify for each bonus entry.
    • Memberships will be verified, any non-members will not receive a bonus entry.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  9. Incomplete or indecipherable entries will be deemed invalid.
  10. For an entry to be valid, it is a condition of entry that the entrant signs up to The Canberra Times daily newsletter, is they are not already subscribed and is happy for their contact details to be collected by Rural Press Pty Ltd (T/A Australian Community Media) and for them to contact the entrant with special offers and promotional material.
  11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  12. The draw will take place at Thoroughbred Park, Randwick Road, Lyneham, ACT 2602 on Sunday, 12 March 2023 after the running of the Black Opal Stakes Race at approximately 5pm. The Promoter reserves the right to alter the time of draw should unforeseen circumstances affect the running of the Black Opal Stakes Race. The Promoter reserves the right to draw additional reserve entries and record them in order, in case of an invalid entry or ineligible entrant.
  13. The winner of the drawn prize will be determined by chance. The winner will be drawn by random selection from a competition barrel or similar option, by Canberra Racing Club CEO Darren Pearce at Thoroughbred Park on Sunday, 12 March 2023 after the running of the Black Opal Stakes Race at approximately 5pm. If Mr Pearce is unavailable to make the draw, a nominated representative from either Canberra Racing Club or John McGrath Auto Group will make the draw. 
  14. The winner will be announced over the PA on the day, followed by a phone call if they do not present themself to the stage. The winner will be emailed on Monday 13th of March confirming their success of winning the prize.
  15. In the event the competition draw is unable to be made at Thoroughbred Park on Sunday, 12 March 2023, the prize draw will take place at the scheduled date and time at the premises of John McGrath Auto Group Kia, Woden, Cnr Melrose Dr & Hindmarsh Dr, overseen by an independent scrutineer. The competition winner will be advised by telephone and email on the same day. 
  16. The Promoter reserves the right to draw additional reserve entries and record them in order in case of an invalid entry or ineligible entrant.
  17. If the prize is unclaimed or un-awarded by the 15th of June 2023, (as per clause 16) the drawn runner-up will be contacted and offered the prize on the same day (15th June 2023).
  18. The Promoter’s decision is final, and no correspondence will be entered into.
  19. The winner will be published on the competition entry page www.canberratimes.com.au/cargiveaway and published in The Canberra Times after the winner has accepted the prize and shared their story, on or after Tuesday, 14 March 2023. Pending when or if the prize draw is delayed due to unforeseen circumstances.
  20. The first valid entry drawn will win a 2022 model Kia Stonic S 1.4L, 74kW, 6 Speed Auto Wagon, Model H8W5K461FBB0FM22. 
    Prize includes:
    • 2022 model Kia Stonic S 1.4L, 74kW, 6 Speed Auto Wagon, Model H8W5K461FBB0FM22, valued at $26,287.91 inc. GST. Delivery, including all on road costs, CTP, registration and stamp duty. 
    Excluded from the prize: 
    • Optional extras are not included but can be purchased at the cost of the winner.
    • Private insurance
  21. Delivery or collection of the car will be made within 5 days of the prize draw based on consultation with John McGrath Auto Group, Cnr Melrose &, Hindmarsh Dr, Phillip ACT 2606. For deliveries outside a 100KM radius of Canberra, a delivery fee may be required, based on the number of KM outside this allocated delivery area.
  22. The prize must be taken as stated, and is not transferable and cannot be redeemed for cash or other goods or services. Further enquiries or details of the prize can be obtained by telephoning Canberra Racing Club on 02 6204 0000.
  23. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. 
  24. If for legal reasons the winner is not able to claim the prize they can nominate a name to accept the prize on their behalf.
  25. If the prize (or part of the prize) is unavailable, the John McGrath Auto Group, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of the equal value and/or specification, subject to the directions of any regulatory authority.
  26. Total prize pool value is up to $26,287.91 inc. GST. Prize, or any unused portion, is not transferable or exchangeable and, cannot be taken as cash, unless otherwise specified.
  27. By submitting an entry form, entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  28. For an entry to be valid, it is a condition that the entrant is happy for their contact details to be collected by Canberra Racing Club and The Canberra Times and for them to contact the entrant with special offers and promotional material.
  29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate, subject to the directions of any regulatory authority.
  30. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
  33. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research  and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will otherwise collect, hold, use and disclose PI as set out in its Privacy Policy, which can be viewed at https://www.acmadcentre.com.au/privacy/. All entries become the property of the Promoter.
