However, the council in response has called on the state government to "quit passing the buck" and take responsibility for further enforcement action on the Broadway Hotel.

Environment Minister Leeanne Enoch originally issued the stop order in September days after a fire gutted the remaining infrastructure at the heritage-listed hotel in Woolloongabba. A stop order exists for a maximum of 60 business days.

The building has sat empty for years after multiple fires since 2010 destroyed further infrastructure, leaving the hotel vulnerable to vandalism.

“This stop order ensures that any demolition of the masonry walls that survived the fire will not be allowed to take place, particularly as there is a lack of compelling evidence that the building’s overall structure is at risk of collapse," she said.

The Environment and Science department had been in contact with the owner of the hotel, Malcolm Nyst, since the fire.

An expert engineer's report commissioned by the department was also supplied to Dr Nyst, showing primary infrastructure in the building was still sound, while some areas including parapets needed shoring up.

Ms Enoch said the department was urging Dr Nyst to conduct key maintenance work including re-boarding up windows to prevent access.

"When the Broadway Hotel was listed on the Queensland Heritage Register, it is described as ‘important in demonstrating the evolution and pattern of Queensland's history’," Ms Enoch said.

“The Palaszczuk government recognises that demolishing this beautiful building would destroy a significant part of Brisbane’s cultural heritage.”

Debate over who is responsible for the enforcement on the site - state or local government - were highlighted during a Brisbane City Council city planning meeting this week.

Lord mayor Graham Quirk wrote to Ms Enoch requesting additional powers be approved under state legislation, giving the council more authority to request maintenance works on the hotel.

The council argued that maintenance works on the building were primarily of heritage value, not of public amenity, meaning the state-administered Heritage Act would be the more appropriate legislation for the Broadway Hotel's maintenance to be viewed under.

But Deputy Premier and South Brisbane MP Jackie Trad said the stop order would give more time for the council to act.

"This extension gives Brisbane City Council more time to step-up and use its powers under the Building Act 1975 to compel the owner to carry out necessary work to stabilise the hotel,” Ms Trad said.

“The Palaszczuk government recognises the historical value of this building, which is an important part of Brisbane’s history and has been on the Queensland Heritage Register since 1992.

“We are taking what action we can to ensure the building is protected for our community and the ball is now in Brisbane City Council’s court.

“Without further enforcement action from council, the Broadway Hotel is at risk, especially as we approach storm season.”

However, council city planning chairman Matthew Bourke said the council would support the state government in efforts to force the owner to repair the fire damage.

“The state government needs to quit passing the buck and exercise its powers under the Heritage Act to ensure the Broadway Hotel does not fall into further disrepair,” Cr Bourke said.

“Unlike council, the state government has powers under the Queensland Heritage Act (section 84) to force the owner to restore the state heritage-listed building to its pre-fire condition and council believes this would be appropriate – for an important part of Queensland’s history.

“The Heritage Act clearly spells out the state government’s powers, which includes forcing the owners to carry out repairs to walls, roofs, gutters and removing fire hazards.

“The state government has previously acknowledged their powers to protect heritage sites, so it baffles me that they are shirking their responsibility now.”

The council issued several enforcement notices to Dr Nyst after the fire, including one on October 12 requiring the premises be secured to prevent unauthorised access, and requiring the installation of solid hoarding and gantry around the site.

On November 12, the council also inspected the hotel to confirm that state-approved demolition works on a chimney and a section of masonry were completed.

The same day, a 'show cause' notice was issued to the owner requesting representations on why the council shouldn't issue another enforcement notice on the hotel's "dilapidated condition".

The gantry and hoarding works were completed in late November.

Meanwhile, community goups are organising an event on Sunday to visualise a new future for the derelict hotel.

Images of the graffiti-laden internal walls of the hotel have been shared on social media, including a waterlogged basement.
