41-year-old Tim McCarthy was the victim of a horror assault in the early hours of Sunday July 24.
18-year-old Daniel Byrne is alleged to have hit McCarthy in the head with his elbow, in what police described as an unprovoked attack.
The attack, which was captured on CCTV cameras, occurred outside the Quick and Go convenience store on the corner of Alinga Street and Northbourne Avenue at about 5.30am.
The attack had left McCarthy in a critical condition at Canberra Hospital, with severe cerebral hemorrhaging.
He underwent emergency surgery to relieve bleeding and pressure on his brain and was placed in an induced coma
McCarthy was put on life support and his mother flew out from Killarney in Ireland to be by his side.
Prosecutors had raised the possibility of charging Byrne with murder if McCarthy had not survived his injuries.
But ACT Health has confirmed that McCarthy has been stabilised.
An ACT Health spokeswoman said McCarthy was sitting up, had regained consciousness and was breathing without life support.
It was unclear whether McCarthy had suffered any permanent brain damage.
According to court documents, McCarthy had been seen on CCTV footage immediately before the incident approaching Byrne and a group of other men.
The ACT Magistrates Court had heard that McCarthy attempted to hug Byrne, before Byrne struck him in the side of the head and walked away.
