The Lyons man was apprehended as he pulled out of the Magistrates Court car park in the city.
The driver's supervising passenger was a probationary license holder.
Station sergeant Susie Ball, from Traffic Operations, said drivers continued to flout drink driving laws in the capital.
"It's appalling that a learner driver, being supervised by a provisional license holder made the decision to drink and drive," she said.
"The law is simple for learner drivers - the legal limit is 0.00."
