A Canberra jury has found a former Marist College teacher not guilty of one count of abusing a boy in his classroom in the 1980s.

But the jurors were unable to come to a decision on the other two counts on the indictment, and on Monday were discharged.
David Kisun, 71, was accused of repeatedly touching the 9-year-old boy inappropriately for the year he was the boy's teacher.
He did not answer questions as he left the ACT Supreme Court on Monday with his family, save: "I certainly am [happy]."
There were three counts of indecent assault on the indictment against Mr Kisun, and each count encompassed a course of behaviour that was said to have happened more than once.
One allegation was that Mr Kisun had sat the boy in the back row of the class and touched him under his unbuttoned shirt while the students were busy with work. Another was that Mr Kisun kept the boy back at recess or lunch, sat him on the teacher's desk and then reached into his shorts through the leg.
The jury was unable to come to a decision on these two counts.
The Crown also alleged Mr Kisun had the boy stand at the back of the room, while he reached around and into his school shorts. The former teacher was acquitted of this charge.
The jury has been deliberating since Thursday. They reached a stalemate on Friday and asked for a direction to help them come to a unanimous decision.
Chief Justice Helen Murrell told them to go back to the beginning and start deliberating again on whichever counts they were stuck.
But on Monday, the jury wrote another note to the court and said it would be unable to reach a decision on two counts.
But they said they would return a verdict on the sole count where they had reached a unanimous decision.
Before taking the verdict the judge called in the jury representative to ask whether they would come to a decision on the last two counts given more time.
"No, your Honour," he said.
Once the verdict of not guilty was handed down the judge thanked the jury members for their service and discharged them.
The remaining two counts against Mr Kisun were listed for directions before the court registrar next week.
In cases where there are hung juries, an accused person may be re-tried, or prosecutors may withdraw the charges.
Mr Kisun's bail was continued.
