While ACT Policing did not press criminal charges, ombudsman Michael Manthorpe said the case had revealed a number of failures in the education directorate's response, including not sharing information crucial to child safety with external regulators.

"My office investigates in private, but I have decided to make this public statement about the
investigation, because although [it] was specific to the actions of the education
directorate, some of the issues we discovered ... may be equally of benefit to other organisations covered by the scheme," Mr Manthorpe said on Wednesday.

The education directorate, which has accepted and begun work on all of the recommendations, said it was committed to both the safety and wellbeing of children and young people and to the reportable conduct scheme, which came into effect in July last year.

Under the scheme, all government and religious organisations must report allegations, offences or convictions related to children to the ombudsman within 30 days, and launch an investigation.

Mr Manthorpe did not reveal details of the case but said the directorate had failed to provide important information to the agency which runs the Working with Vulnerable People scheme as well as the regulator for teacher registration, the Teacher Quality Institute - this information was provided by the ombudsman's own office instead.

Sharing such information, including findings from an investigation, with employment regulators helped ensure the right decisions were made about any future risk to children a person might pose, Mr Manthorpe said.

"I am of the view that it is the responsibility of the employer to share such information, rather than to rely on others doing so."

Mr Manthorpe said some teachers and staff still didn't have "a clear understanding of what constitutes reportable conduct or what to do if such conduct was observed".

While he acknowledged some behaviours could be difficult to define, he said, after the event investigated, staff concerned about what they saw had not taken steps to raise this with either the school principal or the directorate.

Reportable conduct can include grooming, sexting and indecent behaviour that falls below a criminal threshold but criminal behaviour must still be reported to police.

The directorate is currently reviewing its teachers' code of professional practice, in which it will incorporate elements of the scheme.

The ombudsman also called on the directorate to implement a formal risk assessment process to guide decision-making around reportable conduct.

It comes as WorkSafe takes legal action against the directorate for failing to protect staff from violence in schools.

Education Minister Yvette Berry said the government had already thrown more than $7 million behind new occupational violence reforms and another $2.4 would go towards implementing WorkSafe's orders within the next two years.
