Mr Carville, 52, was reported missing from his Evatt home on November 5. His remains were found during a police line search on Defence land at Majura on November 19.

Marc Urlich, 43, pleaded not guilty to being an accessory to Mr Carville's murder and interfering with a dead body in the ACT Magistrates Court on Monday.

He was arrested days after his younger brother, Milan Urlich, 28, was charged with murder over the death of Mr Carville, 52.

Marc Urlich's defence team, led by Steven Whybrow, launched a bid for his release from custody in the ACT Magistrates Court on Monday.

Mr Whybrow argued his client should be freed on grounds the prosecution case relied on a series of assertions and there was no evidence before the court to implicate his client.

But the prosecution said it wouldn't be appropriate to divulge more details of the case against the defendant in court because the police investigation was ongoing.

Magistrate Peter Dingwall reserved his decision, saying Mr Whybrow was entitled to ask on what reasonable grounds his client was arrested.

Mr Dingwall on Thursday said he had been handed a lengthy statement of facts from Urlich's defence team, but there was "not one scintilla" of evidence, such as DNA, phone tap records, eyewitnesses or admissions to support the allegations.

"There is simply no evidence provided to the court for the court to assess the strength of the prosecution case," he said.

Mr Dingwall said the prosecution's refusal to hand up more evidence to support Urlich's charges and bail application raised concerns over whether his arrest was lawful in the first place.

He granted Urlich bail on conditions including that he reside at his home in Victoria, unless to attend court, report to police twice a week and not harass, threaten or intimidate witnesses in the case.

Outside court, defence lawyer Peter Woodhouse said the prosecution had argued Urlich was not entitled to know the evidential basis for his arrest and charge and, not withstanding, should be detained.

"That assertion is outrageous and speaks to the increasingly common zealotry of the director's office in the ACT.

"Thankfully, the learned magistrate rejected that submission."

Details of Mr Carville's alleged killing, which have been closely guarded by police, were revealed for the first time in a statement of facts was tendered as part of the bail application on Wednesday.

Police will allege Mr Carville was strangled at his home before Milan Urlich loaded his body on the back of a ute and drove it to a paddock on Defence land at Majura.

The brothers are alleged to have later moved his body to a creek bed before dumping the ute in Molonglo Gorge.

Mr Carville's badly decomposed remains were found wrapped in a rug and covered with rocks and branches.

An autopsy revealed his cause of death was strangulation and he had a 24-centimetre carving knife tucked into his jeans.

Marc Urlich's case will return to court next month for a case management hearing.

The court previously granted an application from the prosecution which temporarily banned the publication of his image.
