The government last week published its proposed model for anti-consorting laws in the ACT, a move that all but confirms it will follow others states and territories and introduce the controversial measures.

The laws seek to dismantle and disrupt bikie gangs by banning certain individuals from meeting or communicating together, regardless of whether they have criminal convictions.

Human rights experts and lawyers have described it as an assault on the right to free association, and as a significant overreach, particularly given the comparatively low level of bikie activity in the territory.

Now, Canberra's dominant bikie gang, the Rebels, has publicly spoken out about the new laws.

In a short statement to Fairfax Media, Rebels spokesman Ali Bilal, also known as Tony Soprano, has warned the laws are "inconsistent with all Canberrans' human rights".

"If such a law is enacted here, it will mean that some people may not even be able to meet to have a coffee or a beer without committing a criminal offence – even if they have never been in trouble before," he said.

The ACT government is currently taking submissions on its proposed model, which would rely on "consorting warnings" issued by the courts and police, who can, in some cases, act unilaterally against people with no criminal conviction.

Police would be able to ban people from consorting without going to the courts if the targets have criminal convictions, or if intelligence suggests they are "members of a criminal group" whose objective is to commit a serious crime.

In cases where there is no criminal conviction, police would need to go to the courts to get the ban. They would be able to present intelligence in secret to magistrates.

Once a ban is in place, the subjects will face two years behind bars if they repeatedly breach it.

There is an avenue of appeal to overturn the ban if the subjects think it is unwarranted.

Last week, the Human Rights Commission president Helen Watchirs spoke out about the proposal, saying she was not convinced the problem was so large as to justify such a significant curtailment of human rights.

The ACT Bar Association and Law Society made similar comments.

Lawyer Ben Aulich, the principal of Ben Aulich and Associates, said he had hoped Attorney-General Simon Corbell, whose party brought in specific human rights legislation for the ACT, would not follow other jurisdictions in pursuing anti-consorting powers.

"I had also hoped that Mr Corbell would resist the sort of knee-jerk, ill-thought-out laws put forward by the likes of Campbell Newman, and be better than that," Mr Aulich said.

"Once again he disappoints," he said.

The discussion paper released by the ACT government last week concedes bikie activity remains low in the territory.

It estimates there are about 45 members split across three gangs: the Nomads, the Rebels, and the Comancheros.

That number does not include associates.

The bikie landscape has dramatically changed in the last two years. The Rebels have lost their long-held status as the sole club in the ACT, with the club splintering and members patching over to the Nomads and Comancheros.

That has prompted police fears of escalating tensions and violence.

Police also fear that the ACT's lack of anti-consorting laws makes it a valuable meeting ground for clubs.
