A Wanniassa man who admitted he punched the victim, causing him to fall down four stairs, has avoided time behind bars for the unprovoked assault.
Aaron Charles Samios, 25, was sentenced in the ACT Magistrates Court on Tuesday after pleading guilty to negligently causing grievous bodily harm.
Court documents detailed how the victim became involved in an argument about noise with the residents of the unit below him about 7.30pm on June 23 last year.
He had started to walk back up stairs to his unit when he was confronted by Samios, who lived nearby.
Samios told the man to keep his yelling down, then removed his own T-shirt, grabbed the victim by the shoulders, and punched him in the face.
The punch caused the victim to fall about one metre down the stairs and land face first on the concrete.
The force of the fall caused him to black out momentarily, and Samios punched him a second time.
Samios then told witnesses to tell the police his unit number so they knew where to find him.
When approached by police, Samios said: "I know why you're here, I did it, I touched him up."
He was arrested and charged over the incident, making full admissions to officers.
The victim was taken to hospital and treated for fractures to his upper left arm, lower left jaw, and nose. He also suffered a swollen eye and displaced teeth.
The court heard Samios had been honest and co-operative with the author of a pre-sentence report, who rated him a low risk of reoffending.
Magistrate Peter Morrison sentenced Samios to six months' jail, to be suspended upon entering a two-year good behaviour order.
The magistrate also ordered him to complete 200 hours of community service within the next year.
Mr Morrison warned Samios he would be sent to jail if he breached any of the conditions.
