The Legislative Assembly on Thursday voted to support a range of tough new powers to crack down on serious and organised crime, some of which had raised concerns among defence lawyers, the Greens, and civil libertarians.

The most controversial measure, anti-consorting laws targeting bikies, was dropped following significant human rights concerns and a potential backlash from some within the Labor party.

But new bail review powers for prosecutors remained in the bill, which was passed just after midday on Thursday.

The bail review powers allow prosecutors to have accused individuals locked up for 48 hours while they seek an immediate review of a magistrate's decision to grant bail.

The move was immediately condemned by defence lawyers, who described the powers as unnecessary, impractical, and "inconsistent with the human rights principles said to be prized by the ACT government".

Police were also given tougher move-on powers, and non-assocation orders were broadened to bar more offenders from associating with or visiting certain people or places

The bill will be outgoing Attorney-General Simon Corbell's last major reform to the criminal justice system, and, ironically, earned him praise from the other side of the chamber.

"Generally speaking, as people get older they get wiser, and often it is noted that they do become more conservative in their approach," Opposition Leader Jeremy Hanson said.

"In my experience dealing with Mr Corbell over an extended period in this place, I see what he's doing today as sensible," he said.

"It does give me some indication as to why, perhaps, Mr Corbell has been dumped by his left faction."

Mr Corbell announced he was leaving ACT politics after last year being relegated to last spot on the Labor left faction's pre-selection ticket for the Murrumbidgee electorate.

The bail review power is intended for use in exceptional circumstances, where prosecutors fear serious or family violence offenders who have been granted bail still pose a risk to the community.

After indicating they disagree with the magistrate's decision, prosecutors can have an accused person detained for up to 48 hours until the case comes before an ACT Supreme Court judge for review.

Both Labor and Liberals supported the bill on Thursday, while Green and Justice Minister Shane Rattenbury voted against it.

The new powers won't become active until May next year.

The laws were significantly watered down from the original proposal, which allowed for accused individuals to be held behind bars for a far longer period.

Mr Corbell said the laws struck the right balance and ensured the "rights of the accused are limited in the least restrictive way possible".

He said they gave "adequate capacity to deal with error on the part of our magistrates" where the risk to the community is "real or apparent".

"This is the least restrictive means possible to address the risk that is present," Mr Corbell said.

"If there is an alternative that doesn't involve the person being released, then I'd like to hear it," he said.

"Yes this is a complex and difficult issue, but I'm confident the government has got the right balance."

Mr Rattenbury spoke out against the bail review powers, saying there was no evidence of the need for such changes.

"The court will have just hold the whole discussion for whether someone is suitable for bail or not," he said.

"But the approach that's being put forward today, assumes the prosecutor will know better than the judge who has just weighed up all of the evidence."

The Law Society condemned the changes almost immediately. Chair of the society's criminal committee Michael Kukulies-Smith said prosecutors already had an ability to appeal a decision to release someone on bail.

He said the government seemed to doubt the ability of magistrates to make the right decisions.

"The Society remains concerned at the lack of justification put forward by government for the proposed changes," Mr Kukulies-Smith said.

"In fact, the logical inference to be drawn from the government's introduction of the review power is that it lacks confidence in the courts to appropriately manage bail applications."
