Cameron Ashcroft, 23, and Todd Elphick, 26, have appeared for two weeks before the ACT Supreme Court on allegations they conspired to intentionally inflict grievous bodily harm on Brendan Scott Welsh, 28.
Mr Welsh was shot dead as he sat in his car outside the Hughes shops by Kai Yuen, 28, in May 2010. The shooting came after an argument between Yuen and Mr Welsh escalated after Yuen's work van was damaged.
Ashcroft and Elphick are accused of agreeing to seriously harm, not murder, Mr Welsh.
Crown prosecutor Shane Drumgold has led a circumstantial case against the two, saying their actions on the night Mr Welsh was shot and in the weeks before prove they were conspiring to shoot him in the foot.
But the pair's defence barristers - John Harris, SC, and John Purnell, SC - have said there is no evidence that either of the men was ever party to the conspiracy.
Mr Purnell, who is representing Elphick, said that even if an agreement existed, his client had withdrawn from it during the night, telling Yuen not to bring the gun, to call off his pursuit of Mr Welsh, and warning that he shouldn't ''do anything stupid''.
Two witnesses have told the court of overhearing Ashcroft and Elphick discussing shooting Mr Welsh in the foot. In one version, Ashcroft was heard to respond ''that's a little bit harsh''.
Elphick allegedly drove Yuen around the city for hours trying to confront Mr Welsh, then contacted Ashcroft and gave him $450 to help set up a drug deal to lure the victim to Hughes.
The prosecution allege Elphick knew Yuen was wearing a disguise and carrying a gun as he tried to confront Mr Welsh.
They allege that Ashcroft also knew Yuen was holding the gun and in disguise when he helped to facilitate the changing of the meeting place from Hughes ovals to Hughes shops.
Ashcroft is accused by prosecutors of going to talk to Mr Welsh as he sat in the car, and then moving one or two steps to the side just before Yuen emerged from the dark with the shotgun.
Yuen gave evidence earlier that he was angry and had intimidated the pair into helping him.
